Designing, implementing and maintaining an antitrust compliance programme: the perspective of both an in-house counsel and an external legal consultant

This session examines the overall benefits of adopting antitrust compliance programs as well as their relevance from the different perspectives of both in-house and external legal consultants.
Enrico Fabrizi will give some practical indications on the various activities to be carried out when designing and implementing specific measures. He will also outline the particular importance of the program for companies operating in bidding markets.
Nicola Lopez will highlight the critical elements and steps for a compliance program to be effectively implemented in the context of a multinational company.
The session will close with joint remarks on the benefits of a consolidated cooperation between in-house and outside counsels, both in the day-by-day consultancy and in the effective management of the relationship, to ensure compliance with the program and the competition rules.

The session will explore the not always easy interplay between Life Sciences sectoral regulation and competition rules. Building on the issues that have emerged from a number of key recent cases, the panel will discuss how the current relationship between competition authorities and medicines agencies could be improved for the benefit of all stakeholders involved, the room that competition law considerations should have in the post-Covid19 EU pharmaceutical strategy for Europe and the possible ways to address the regulatory/market-access challenges raised by the new wave of innovative therapies (e.g., gene therapies) with a view to minimizing disruptive ex post antitrust intervention.
