Private enforcement: the rise of litigation funding in Europe

Private enforcement can substantially improve the functioning of a competition regime allowing victims of anti-competitive conduct to obtain reasonable compensation and helping deter anticompetitive conduct. However, it is well known that private antitrust litigation can be expensive to bring and prosecute.
In the last decade, the advent of litigation funders in the market has changed the landscape of private antitrust litigation offering victims a new innovative solution: litigation funders have begun financing plaintiff-side antitrust litigation, shifting risk of losing the case from the victims to the funders.
Three experts in the field – one of the country’s foremost litigators of private enforcement, a former general counsel of a large multinational company and a representative from a leading European litigation funder with deep experience in antitrust) address the key topics concerning private enforcement in Europe with a particular focus on the role of litigation funding in the private enforcement actions.
