The Rise of Antitrust Enforcement in Labor Markets: a Transatlantic Discussion

Historically the relationship between antitrust law and the welfare of workers has largely been one of indifference. This has radically changed over the last few years. The panel will provide an overview of the enforcement action developments in the U.S., where the promotion of competition in labor markets is a clear priority of the FTC and the DOJ with respect to both conduct investigations and merger review, and will discuss whether an emerging enforcement trend in this respect can also be identified in Europe. Focus will also be on whether antitrust enforcement in labor markets is consistent with the fundamental goal of antitrust law, namely the promotion/protection of consumer welfare, which, even if considered by some an outdated or defective standard, still underpins current antitrust enforcement.
