This session explores how AI and FinTech pose specific challenges to merger control, emphasizing the Law and Economics angles. As common ownership in FinTech markets grows, it uniquely impacts competition and innovation. Additionally, non-horizontal mergers that aggregate consumer data raise new antitrust concerns. The session will also examine recent merger cases, focusing on data-based theories of competitive harm and proposing metrics for assessing data complementarity and overlap.

This discussion aims to equip antitrust policymakers with insights to navigate the complexities of AI and FinTech in merger control, promoting competitive and innovative financial markets.
